Among the most serious traffic accidents are those involving pedestrians because pedestrians are completely vulnerable to serious or fatal injuries when struck by a moving vehicle. Human flesh and bone is no match for a vehicles mass and structural strength. Even a slow-moving vehicle can cause fractures and major injuries to a pedestrian.
According to the National Highway Traffic Safety Administration pedestrian fatalities accounted for over 11 percent of all fatalities resulting from motor vehicle crashes in 2002. In fact, from 1975 to 2002 over 166,000 pedestrians were killed in the United States and Detroit is ranked in the top five for the highest pedestrian fatality rate. Speeding, increased traffic volume, driving under the influence of alcohol, illegal turns, increasing inconsideration for pedestrians, SUVs, and the use of cell phones are all factors contributing to the problem.
Driver negligence can often be attributed to many pedestrian accidents and "who was at fault" is frequently disputed.
